I think the ESRB likes to err on the side of caution when choosing between T and M(after all, how many T games are there really?) because they're afraid of getting sued :/

i think that esrb has no choice but to take a precautionary stance in their ratings because of the government breathing down on their necks. It may seem to a gamer that some games can be a bit over-rated but to parents i think.......they feel safer knowing at least...that they can control the content of what their children play.
Try typing the word "fa!l" on dgemu when posting, it appears as succeed. Spell it properly though, F-A-I-L without the dashes, doh!
