If she didn't order the tea, why should she pay, unless previously stated by the restaurant!

I think she should pay for the tea, because if she ordered it then she should pay for it unless it was free then she shouldn't have to pay for it.

Due to the fact that the waiter brought the tea when they entered but they didn't order it then it would be complimentary and therefore she wouldn't have to pay.

If they did not eat or drink anything, nor dirty anything either then there should be no reason for them to have to pay anything. I would actually ask for the manager to be brought into the discussion. However, if the restaurant is by reservation only then yes I can understand having to pay for a canceled reservation.

I'd say no. Just bring that kettle of tea to the next customer.

It doesn´t say that she ordered it so, NO she should not pay. If she had ordered it then it would be a diffrent story.

The woman went into the restaurant with the intention of having a meal. In many restaurants, when you sit down you get served tea regardless of whether or not you asked for it, and you are then charged for the tea per head, or per pot. If she was in one of these restaurants then I think it was fair for the waiter to give them tea, and then to charge her for it. However, I also think it would be reasonable for the waiter/manager to let them off.

Of course she should pay.If she didnt want to eat or drink why did she sit in the restaurant.Restaurants dont let you sit there and get free air-con all day long you will bother them.Just think if you had a restaurant and it was always full of people just sitting there and not buying anything you would go bankrupt! So the only way to just get a little payment just for renting the seats to you is to give you something you have to pay for.

I don't think she should pay the waiter she didn't drink the tea. So she shouldn't pay. If I was in this situation I'd just go and tell him to call the manager and watch him get embarrassed. Of course if I was wrong and i did have to pay for the kettle of tea that I didn't drink nor order.... I would be very embarrassed to be in that situation.I suppose i should stop rambling and just summarise by saying I don't think she should pay.

Noooo, that wouldn't really be fair if the woman didn't order anything. The waiter could probably scam people out of their money in real life that way. It's like hidden fees, they tell you it's free but you still have to pay for shipping and stuff :P

A woman and her friend are stopping at a restaurant. She and her friend enter the restaurant and sit at a table. A waiter comes by and sets down a kettle of tea. The woman and her friend talk for a while, and then the woman gets a phone call saying that she is expected at her office. She and her friend leave, but are stopped by a waiter. The waiter said they didn't pay the bill yet, and is threatening to call the manager. The woman protests that she never ate nor drank anything, but the waiter says that she still has to pay for the kettle of tea.

Reading this and knowing where I come from, this immediately turned into an asian situation in the back of my mind, where the waiter is a fat asian and the women are white european travellers.I think she shouldn't have to pay. This is a pot of tea put down by the waiter voluntarily. UNDER NO CIRCUMSTANCE did the women ask for a pot of tea. THERE IS NO EVIDENCE of there being any sign of "Hey, you sit down, we make tea quick smart, you pay!"

No! If, as seems to be the case, the tea was some kind of complimentary standard drink that the waiter brought out of his initiative and the two customers seriously ate and drank nothing at all (and also didn't lick any of the forks or anything), there's no reason they should pay simply for entering and sitting down.Hmm, if the result is that she was legally required to reimburse the restaurant just for that, it would be pretty retarded. In fact, maybe people should just pull weird pranks like inviting friends over to their houses and then charging them for eating their snacks when they're about to leave (isn't it kind of implied that, usually, the host is covering the light food since it's between friends?). Retarded technical loopholes are not the way to go. Producing logical outcomes based on proper morals and appointing blame or responsbility to the relevant parties is.

WOW! 317 replies to this one topic. Impressive.Anyway, it's quite simple. She didn't order or ask for the tea. It came to the table without her request. Therefore, she has no need to pay for it. It was the waiter's fault. If it wasn't one of those free complementary stuff, he should've asked the woman and friend if they wanted the tea before going to fill it up.Sure the restaurant's lost out on the money from the tea but that's the waiter's fault. It's common sense and he didn't use it. Man! If I was there I would've stood up for the woman and given him a good one-two ya know :D

The woman shouldn't pay, since they didn't order the kettle of tea. It's sort of like the bread you get even before you order at some places. It's called.. FREE FOOD!

Its retarded, because you earn the what, $2.50 on tea? And lose a potential future customer and her immediate friends? Good math that. I'm a skinny asian and that puts me to shame (if Auzzie Wingman is to be believed - as an aside, Asian waiters in Australia are mildly anal-retentive, I should know. I was one)

Hotel rules and manners are the same everywhere. You do not pay for what you eat you pay for what you buy. That,In this case is a tea.She bought it.It was produced and given to her.Now she must pay. It's like ordering a portrait of yours and saying no thanks.I don't want your ugly painting scaring off people on my wall.So you should take it.It is yours and you must pay.<May I state that in some cities due to the rush you must pay a caution deposit of Rs.100 on entry to the restaurant.$2.50 is a lot.Hell I could drink tea and have snacks for a week with that. (Unless its singapore dollars. Then just tea)Morning and evening.Great answer Dayum, That is one hell of a point.

She bought it.

Wait! How did you come to that conclusion. Where in that opening post does it suggest that she actually "BOUGHT" it. The text mentions that she sat down at the table and the kettle of tea was put down. That does not mean she bought it.So in that case, we go by what you said prior to that:

You pay for what you buy.

Well she didn't buy it so she shouldn't pay.
