If you were to be so kind to ponder a bit more on the whole post I did say the portrait example.She orders a portrait.It is through trust that they do not make her pay for it.As they want to be rewarded for their good tea/Portrait.If it was a different kind of restaurant served by robots she wouldn't get away because The bill is based on what you order Not what you eat.Understand.They can have complimentary stuff and samples but charge you for what you order Unless you cancel it in advance.Same with railway tickets.Also i believe the question does come down to the argument of did she buy it or not?If she did buy it she should pay.If not,She shouldn't.I have, in the above paragraph expressed my view on the situation and i feel she should pay.But 2.50 is a lot/I would split it with her If i could get the tea 80-20.I pay 80 although i could use this argument and reduce it to 50-50.

But... but...I understand the portrait example. Ok if I asked a painter to do my portrait then I would definitely pay. But now let's say that I was sitting on a park bench just relaxing and from the middle of nowhere a painter comes and paints my picture and then expects me to buy it, then there is no way I would be obliged to buy and take it. Simply because I didn't ask.This is exactly what's happened here.Nowhere in the text does it mention that she "asked" or "ordered" or "bought" the tea.It only said they sat down at a table. There was no mention of her requesting the tea. Normally, you don't go and order straight away once you enter a restaurant. You will sit down somewhere first and then order something.For example, the last time I went to a restaurant with a few friends, we sat down at a table for about 10 minutes just talking about stuff and deciding what to order. We didn't order anything within those 10 minutes so we wouldn't be obliged to pay for anything that came to our table within those 10 minutes.Similarly the case with the woman. They JUST sat down at a table. They probably were going to order something but couldn't because unfortunately the woman had something to do. The tea was not called for so why should she pay?

My sincere apologies for my ignorance.It seems that, because i first read the post quite some time ago, I didn't take in the whole thing properly.My arguments were based on the belierf that she had asked for it.But the waiter had indeed put it there as a complimentary item.It is meant to win over poeple and make a good name.So she must not be made to pay for it.Even if she offered to.The manager will be called.Jamzemu will explain the situation.Manager says Oh,Calls them both to the office.Apologises to the lady and buys her good tea with snacks.Scolds the waiter and gives him a pos.Leaves behind a message, Next time you do that I'm firing you.I see your point,Jamz, You are correct.She must not be made to pay as she did not ask for it and it is a complimentary item (I even talked about those in the previous post.I feel so dumb for not going through the first post again.)I'm sorry for being an ignoramus (and possibly a whatafoolamus.LOL Dominotrix)Sincere apologies and thank you for pointing out my mistake.If she was to pay then that would be dumb.Sue them.

WellIt isn't that she wanted to not eat there... But accidentely got an urge call...But on the other hand, if everybody go there and just sat there and go away...well i wont make a fuss about it and just pay...

I dont even know why I chose the choice for her to pay. I just think she should. The waiter had the decency to make and deliver the tea, as a service of goods. That should require the lady to pay.

No she should not have to pay for anything if she did not ordered anything. Although it is not well viewed by society to go in restaurants and not order anything, it is not against the law, and the restaurant should not charge for anything that she did not ordered.

isnt tea supposed to be complimentary and free? in chinese restuarants u dont pay for anything unless u order somthin...

She should pay, when you enter a restraunt and you are seated you are using up customer space and you are not only paying for the food but for the enviroment of the restraunt.

If the waiter had put the tea down before the woman and her friend order anything, of course she shouldn't pay! Besides free tea is an expected in Asian resturaunts.

Even when I only went to a restaurant to meet friends and ordered (free) water, I would leave a tip at least. You are taking up time and space for that business. The lady consumed something, she needs to pay for it.

depeneds, if she's in a hurry, and the restaurant demands payment, then for the lady it's probably easier to pay (minimum cover charge) then wasting her time.. i.e. time is more valuable at the moment.

Of course she shouldn't have to pay. She didn't order anything. If I was seated and, before ever ordering, the waiter plops a 24 oz steak right in front of me, and I decide to leave without touching anything, am I obligated to pay for it? Nope. It's the waiter's fault for assuming I'd want something, and something specific at that.And there doesn't seem to have been any consideration for whether or not the lady even liked tea.

That stingy waiter should just take that tea kettle back to the kitchen. It was unused, and can be given to a different customer.

I believe that she should pay for the tea because since she was going to eat so the tea was brought. Seriuosly you dont just go into a restraunt and sit at a table and start chatting and then leave do you? That lady just took a place where another person could have sat so paying is really not that unreasonable.

If she ordered she should but if it is only of those service thingy than it is difficult to say for sure.. Like in Singapore sometimes they charge a small fee for tea and towels.. So I guess just pay for tea and towel like 2 bucks ? Or just have a shouting match with the manager...

They did enter the restaurant and sit down so it's rude but they shouldn't pay as they didn't order anything and didn't drink the tea.

If she asked for the tea or when asked if she wanted tea she said yes, then she needs to pay, but if they were sat down at the restaurant and the waiter just came over and poured her some tea without her consent then the waiter is in the wrong
