She didn't ask for the tea and they could reuse the tea right if she didn't drink it :P

She didn't order the tea. So she shouldn't pay (if the restaurant gave you bread, they would reuse the bread if it was untouched, right? So why can't they do that here- she didn't touch it).

I was discussing a what if question with my friend. Here's how it goes.A woman and her friend are stopping at a restaurant. She and her friend enter the restaurant and sit at a table. A waiter comes by and sets down a kettle of tea. The woman and her friend talk for a while, and then the woman gets a phone call saying that she is expected at her office. She and her friend leave, but are stopped by a waiter. The waiter said they didn't pay the bill yet, and is threatening to call the manager. The woman protests that she never ate nor drank anything, but the waiter says that she still has to pay for the kettle of tea.Should the woman pay or not?????A few days before this I was watching a TV show and saw surprisingly, there was an event that was strangely similar to this question... Weird, huh?

I think taht the women should pay because she is the one who is wrong and yes my anser sounds kind of retarded because im half asleep and i dont think i actuall understood.

I also think no because she did not order the tea, they simply set it in front of her, and like other people said they can simply reuse the tea as it has probably only been at most 5 minutes since they gave it to her, its still probably warm.

If she didnt touch any of the food and drink, then she shouldnt need to pay. The waiter could take the food and drink bak and warm it up for the next customer :br:

If the call is urgent at the office, might as well pay and get the hell out of there.

Of course not. She didn't order it. She didn't agree to it. She didn't drink any. They didn't ask her about it. They didn't ask "Want some tea?", and she didn't say "yes, thank you". She's late for an appointment so it really doesn't matter if she feels embarrassed or not. The manager can sue, but they can counter sue. They seriously don't have to pay for anything they didn't use, didn't ask for, and barely thought about. It isn't really like using the bathroom and paying for it. It's like NOT using the bathroom, but before you leave, you must donate to it to keep the bathroom clean. I mean come on. From the sounds of it, she barely even looked at it. She should just leave. She might have to ignore the manager and waiter screaming after her, but she can ignore them. If there's a problem with that, they can go to court about it, even though, they probably don't have the identity of the woman. But they can still go to court. AFTER the appointment at her office, which may not even be that importan anyway. Summary: No. The waiter is an idiot.

Nah she shouldn't have to pay. They should just let her go away nicely. Only if she drank something, or actually ordered something should she have to pay.

I agree with - if it's complimentary and wasn't ordered, then she shouldn't pay because it'd be like paying for water just because it's on the table.

i think she shouldn't have to pay, because, really, she didn't order anything. all she did was step in, chat for a while, and then leave. i doubt they can legally charge her for being present in the building. she could possibly have left a tip for the waiter for giving them the tea though :D

Hmm... that's a tough one. On the one hand, I can understand why she would have to pay in the eyes of the restaurant and waiter, but on the other hand her statement that she did not drink nor eat anything is equally valid. In the end, if it were me, I wouldn't have paid. Precisely because I did not order anything, nor did I touch the complimentary "snacks" that were offered to me. It would be different, if I hadn't spent the entire time chatting, but I have almost found myself in a similar situation and with a similar outcome. So, no, she shouldn't have to pay.

I'd say no, they didn't exactly order the kettle of tea, it was given to them. If they went ahead and actually ordered something, I doubt they would charge the two for the tea.

No way should she pay if the tea was complementary, or if she was just sitting around, i mean they could have asked her to leave, and not hit her with a bill when she was already out the door, thats stupid. If she did order the tea though, she should just throw down a few $$ on the table and walk out, i mean how much does tea cost?!?!

Although technically the woman should pay, I think it's an ordinary courtesy for the restaurant to say that she doesn't have to.
